Düsseldorf, Germany – Ox Mobile Technologies GmbH announced today that it has filed a patent infringement lawsuit before the Düsseldorf Regional Court against AGCO Corporation, AGCO International GmbH, and AGCO GmbH. The action concerns alleged infringement of the German portion of European Patent EP 2 068 581 B1, a patent relating to wireless mobile communications technology used in LTE networks.

According to the complaint, Ox Mobile Technologies seeks information, accounting, and damages related to the alleged use and distribution of LTE-capable products in Germany. The lawsuit focuses on technology that Ox Mobile Technologies contends is essential to the LTE standard and is implemented in connected agricultural machinery and precision agriculture products marketed and distributed by AGCO and its affiliates.

The patent asserted in the action, EP 2 068 581 B1, relates to handover procedures in cellular mobile communication systems. Ox Mobile Technologies alleges that LTE-enabled agricultural equipment and guidance systems distributed under AGCO brands, including products marketed through the Fendt and PTx Trimble portfolios, practice technology covered by the asserted patent.

Ox Mobile Technologies stated that the lawsuit reflects its commitment to protecting the value of its intellectual property and ensuring fair licensing of innovations that contribute to globally adopted wireless communication standards. According to the filing, the asserted patent forms part of a broader cellular communications portfolio that includes technologies incorporated into LTE and GSM standards and that has been licensed across the mobile communications industry.

The complaint seeks a declaration that the defendants are liable for damages arising from the alleged infringement, together with orders requiring disclosure of supply chain and sales information, accounting of relevant activities, and reimbursement of legal costs.

“Strong intellectual property protection is essential to sustaining innovation in wireless communications,” said a spokesperson for Ox Mobile Technologies. “We are taking this action to enforce our rights and to ensure that implementers of standardized technologies respect the licensing framework that supports continued technological advancement.”

The case has been filed in the Patent Litigation Chamber of the Düsseldorf Regional Court, one of Europe's leading venues for patent enforcement disputes.
